Terms of Service

Version updated in May 2025

These Terms of Service (“Terms”) form a binding contract between you and GUARION FILMES LTDA. (“Guarion,” “we,” “our”), a Brazilian company, CNPJ 59.026.448/0001-27, headquartered at Rua Maria Figueiredo 595, 22, Paraíso, São Paulo-SP, Brazil. Filmcook is a software-as-a-service platform that lets users search and organise audiovisual references for strictly educational and non-commercial purposes. By creating an account, purchasing a subscription or accessing any portion of Filmcook you agree to these Terms and the accompanying Privacy Policy.

1. Introduction

  • o Filmcook – web application and its APIs at filmcook.com, offered exclusively for educational, study and creative reference use, direct commercial use prohibited.

  • Third Party Content – audiovisual works, images, texts or metadata made available as a reference by human curation or external integrations (e.g. Vimeo, YouTube).

  • User Content – any data submitted or imported by the User (descriptions, tags, playlists, comments, images, etc.).

  • Plans – subscription models disclosed on the pricing page, charged in BRL or USD via Stripe.

  • LGPD – Law 13.709/2018 and ANPD regulations.

2. Eligibility and account.

You must be at least 18 years old, or 13 to 17 with verifiable parental consent, and provide accurate name, e-mail, CPF/CNPJ (for invoicing), and payment details. You are responsible for safeguarding your credentials and for all activity in your account.

3. Plans, billing and discounts.

Subscriptions are prepaid and renew automatically until cancelled. Payments are processed by Stripe; VAT or ISS will be added where required. Under the Brazilian Consumer Code you may withdraw within seven calendar days of the first charge for a full refund.

Early-access benefit: anyone who registered during the beta period that ended 13 May 2025 and purchases any plan with the same e-mail by 13 June 2025 receives a perpetual 40 % price reduction while the subscription remains active without interruption. If the plan is cancelled or lapses for non-payment the discount is lost and will not be re-granted.

4. Licence and acceptable use.

Filmcook grants you a personal, non-exclusive, non-transferable, revocable licence to use the platform solely for research, study and creative reference. Commercial exploitation, redistribution of third-party footage or stills, scraping, automated downloads, reverse engineering and any unlawful or defamatory activity are prohibited.

5. User content.

You retain ownership of anything you upload but grant Guarion a worldwide, royalty-free licence to store, process and display that material inside the platform. If you are the rights-holder for content that appears in Filmcook and you want it removed, follow the procedure described in the Privacy Policy; we will comply within fifteen days.

6. Intellectual property of Filmcook.

All source code, features, UI design and curated databases are copyrighted and belong exclusively to Filmcook. The word mark “Filmcook” is pending registration with the Brazilian INPI; use of any logo or branding outside these Terms is forbidden.

7. Support and maintenance.

Human support is available Monday to Friday, 10:00-19:00 (BRT) via support@filmcook.com or the in-app chat. We may suspend service without prior notice to mitigate critical incidents or obey legal orders and will inform users as soon as practical.

8. Termination.

We may suspend or close an account for breaches of these Terms, fraud or unpaid invoices older than ten days. You may cancel at any time from your dashboard; access continues until the end of the paid cycle.

9. Disclaimers and limitation of liability.

Filmcook is provided “as is.” To the fullest extent permitted by law we disclaim warranties of fitness for a particular purpose and limit aggregate liability to the fees you paid during the twelve months preceding a claim. We are not liable for decisions you take based on references, outages caused by third-party providers, or unlawful content posted by users.

10. Communications.

The e-mail address you supply may be used for transaction-critical messages (billing, security, legal updates) and for occasional product announcements we believe are relevant to your account. You can unsubscribe from the latter without affecting core notices.

11. Compensation

You will indemnify Filmcook for losses or expenses arising from any breach of these Terms or third party rights committed by you.

12. Changes to the Terms or Service

12.1 We may update these Terms as required by law or to improve the service.

12.2 We will notify you by email 10 days in advance; continuing to use the service after this date constitutes agreement.

12.3 In case of disagreement, you may terminate without penalty up to the effective date of the change.

13. Comunicações

13.1 Official channels. Communications sent to the registered email or via in-app notifications are valid.

13.2 Use of email. The address provided may be used by Filmcook to:

• essential transactional messages (payments, expiration, password reset);

• important information about the account or about new features/significant changes to Filmcook;

• notices of maintenance or changes to these Terms.

The User may choose to unsubscribe from promotional communications, without prejudice to emails strictly necessary for the provision of the service.

14. Applicable law and jurisdiction

14.1 Brazilian legislation applies (CDC, LGPD, Marco Civil da Internet, Decree 7.962/2013).

14.2 Consumers may choose the jurisdiction of their domicile (art. 101 I, CDC). For other Users, the jurisdiction of the District of São Paulo/SP is elected.

15. Final provisions

The Data Protection Officer (DPO) will be appointed by Filmcook and disclosed with full name. The official contact is dpo@filmcook.com and the opening hours are on weekdays, from 10 am to 7 pm, Brasília time.

Person in charge of processing personal data

15.1 Tolerance of infringements does not imply waiver of rights.

15.2 If any clause is deemed invalid, the remaining clauses shall remain in force.

15.3 These Terms are binding on successors in title.
