Privacy Policy

This Policy describes how GUARION FILMES LTDA., CNPJ 59.026.448/0001-27, headquartered at Rua Maria Figueiredo, 595, Conj. 22 – Paraíso, São Paulo/SP (“Guarion”, “we”), collects, uses, shares and protects personal data when operating Filmcook, a SaaS platform intended exclusively for educational and creative reference purposes, without direct commercial use.
By creating an account or using the platform, you (“User”) agree to the practices below, in accordance with the General Personal Data Protection Law – LGPD (Law 13,709/2018).

Data we collect

To create and maintain the account, we collect name, email address, encrypted password, CPF or CNPJ and country or state of residence. This data is necessary for the execution of the subscription contract, to validate the User's identity and to enable the issuance of invoices.

During payment, Filmcook receives from Stripe only the encrypted transaction token, the last four digits of the card, the charge status and the billing address. This information enables us to process subscriptions and comply with legal obligations of a tax nature.

When the User browses the platform, we record the IP address, device identifier, access dates and times, search terms entered and the history of references viewed. These records enable the personal history feature, the provision of content recommendations, the continuous improvement of the service and protection against fraud.

Messages sent to support, as well as all email exchanges and support tickets, are stored to enable responses, document interactions and prevent illicit activities.

Filmcook does not request or wish to process sensitive data, as defined in article 5, item II, of the LGPD. If the User enters information of this nature in free text fields, we will adopt anonymization or immediate deletion.

Use of data

Registration data enables the User to be authenticated and the session to be kept active. Payment data enables recurring billing and the issuance of tax documents. Usage information, especially the history of references viewed, allows the User to be presented with their own history, suggest new relevant content and improve internal functions. Records are also used to monitor security, detect fraud and generate aggregated statistics that guide technical decisions.

Filmcook sends strictly essential communications regarding accounts, billing, new features or changes to legal documents. You can opt out of updates by clicking the unsubscribe link in each email, but notices essential to the provision of the service will continue to be sent.

Sharing

Filmcook only shares personal data with essential third parties. All third parties act as processors under contracts that impose confidentiality and limited processing on Filmcook's instructions. Filmcook does not sell, rent or lease lists of data to anyone.

Retention and disposal

As long as the subscription remains active, we keep the registration, usage and history data. The history of references viewed is kept for up to twelve months or until manually deleted by the User, whichever occurs first. If the account is cancelled, we will delete or anonymize personal data within ninety days, except for tax information, which the law requires to be kept for five years.

Rights of the holder

The User may confirm the existence of processing, access or correct data, request portability, request anonymization, blocking or deletion of unnecessary information, obtain details about sharing and revoke consent, whenever applicable. Requests must be sent to privacidade@filmcook.com, and Filmcook will respond within fifteen calendar days. If the User wishes to delete material of which he is the author and which is published on the platform, he must demonstrate ownership and request removal using the same email address; the deletion will be processed within the same period.

Cookies

Filmcook does not use cookies or third-party trackers. Session data is only stored on the server, without installing files on the User's device.

Changes to this Policy

We may update this Policy to reflect legal or operational changes. Any material changes will be communicated by email ten days in advance. Your continued use of Filmcook after the indicated date will mean that you agree to the new conditions.

Person in charge of processing personal data

The Data Protection Officer (DPO) will be appointed by Filmcook and disclosed with full name. The official contact is dpo@filmcook.com and the opening hours are on weekdays, from 10 am to 7 pm, Brasília time.

Final provisions

This Policy supplements the Terms of Use of Filmcook. Any dispute will be resolved in accordance with Brazilian law, in the jurisdiction of the District of São Paulo/SP, without prejudice to the consumer's right to choose his/her domicile.
